By signing a deposit account signature card or otherwise applying for, opening or maintaining an account with Tri City National Bank, you accept and agree to the terms of this policy.

This statement contains the rules which govern, where appropriate, your deposit account with us. Unless it would be inconsistent to do so, words and phrases used in this statement should be construed so that the singular includes the plural and the plural includes the singular. In additional disclosures, you will find a schedule of the applicable interest rates, methods, qualifying balances and charges. Please read these rules carefully; continued use of your account with us after receipt of this statement means you agree to these rules, you agree to pay the fees, as disclosed or amended, and you give us the right to collect the fees, as earned, directly from the account balance. If you have any questions, please call us.

Our relationship with our deposit customers is regulated by Wisconsin state law and federal law, especially the law relating to negotiable instruments, the law regulating the methods of transferring property upon death and the rights of surviving spouses and dependents, the law pertaining to estate and other succession taxes, the law regarding electronic funds transfer, and the law regarding the availability of deposited funds. This body of law is too large and complex to be reproduced here.

The purpose of this statement is to:

  1. summarize the rules applicable to the more common transactions;
  2. establish rules to govern transactions or circumstances which the law does not regulate; and
  3. establish rules for certain events or transactions which the law already regulates but permits variation by agreement.
We may permit some variations from this standard agreement, but any such variation must be agreed to in writing either on our signature card for the account or in some other written form.

As used in these rules the word "we" means Tri City National Bank and the words "you" means the account holder.

LIABILITY - Each of you agrees, for yourself (and the person or entity you represent if you sign as a representative of another) to the terms of this account and the schedule of charges that may be imposed. You authorize us to deduct these charges as accrued directly from the account balance. You also agree to pay additional reasonable charges we may impose for services you request which are not contemplated by this agreement. Each of you also agrees to be jointly and severally liable for any account deficit resulting from charges or overdrafts, whether caused by you or another authorized to withdraw from this account, and the costs we incur to collect the deficit including, to the extent permitted by law, our reasonable attorney's fees. We may permit each of you to endorse for cash, or deposit to the account, items payable to any of you. Each of you agrees to hold us harmless for any action of the others concerning the account.

DEPOSITS - Any items, other than cash, accepted for deposit (including items drawn "on us") will be given provisional credit only until collection is final (and actual credit for deposits of, or payable in, foreign currency will be at the exchange rate in effect on final collection in U. S. dollars). We are not responsible for transactions initiated by mail or outside depository until we actually record them. All transactions received after our "daily cut-off time" on a business day we are open, or received on a day in which we are not open for business, will be treated and recorded as if initiated on the next business day that we are open.

WITHDRAWALS - Unless otherwise clearly indicated to the contrary, any one of you who signs in the space designated for signatures on the signature card, including authorized signers, may withdraw or transfer all or any part of the account balance at any time on forms approved by us. Each of you (until we receive written notice to the contrary) authorizes each other person signing this card to endorse any item payable to you or your order for deposit to this account or any other transaction with us. The honoring of one or more overdrafts does not obligate the Bank to honor future overdrafts, and you should not rely on the bank to honor an overdraft. Withdrawals will first be made from collected funds, and we may, unless prohibited by law or our written policy, refuse any withdrawal request against uncollected funds, even if our general practice is to the contrary. We reserve the right to refuse any withdrawal or transfer request which is attempted by any method not specifically permitted, which is for an amount less than any minimum withdrawal requirement, or which exceeds any frequency limitation. Even if we honor a nonconforming request, repeated abuse of the stated limitations (if any) may eventually force us to close this account. We will use the date a transaction is completed by us (as opposed to the day you initiate it) to apply the frequency limitations. On interest-bearing accounts other than time deposits, we reserve the right to require at least seven days' written notice before any withdrawal or transfer. Withdrawals from a time deposit prior to maturity or prior to the expiration of any notice period may be restricted and may be subject to penalty. See your notice of penalties for early withdrawal. Unless specifically designated by us, if you allow your account balance to fall to a zero blance on any given day, we may consider the account to be voluntarily closed by you as of that date. We will have no liability for any transactions that you intend to occur after the account is closed.

OWNERSHIP OF ACCOUNT AND BENEFICIARY DESIGNATION - These rules apply to this account depending on the form of ownership and beneficiary designation, if any, specified on the account records. "Party" means a person who, by the terms of an account, has a present right, subject to request, to payment from the account other than as an agent. A beneficiary of a P.O.D. account is a party only after the account becomes payable to them by reason of their surviving the original payee. A minor may be a party to an account, subject to the withdrawal restrictions of Wisconsin law. Unless the context indicates otherwise, "party" includes a guardian, conservator, personal representative or assignee, including an attaching creditor, of a party. Single Party Account - is owned by one party. Marital Account - is an account established without the right of survivorship by two parties who claim to be husband and wife and is payable on request to either or both parties. Joint Survivorship Account (Not As Tenants In Common) - Such an account is issued in the name of two or more persons. Each of you intend that upon your death the balance in the account (subject to any previous pledge to which we have consented) will belong to the survivor(s). If two or more of you survive, you will own the balance in the account as joint tenants with survivorship and not as tenants in common. Joint Account - No Survivorship (As Tenants in Common) - is an account, other than a Marital Account or Joint Survivorship Account, owned by two or more parties and payable on request to one of two or more parties. The parties do not intend (merely by opening this account) to create any right of survivorship in any other party. We encourage the parties to agree and tell us in writing of the percentage of the deposit contributed by each of you. This information will not, however, affect the number of signatures necessary for withdrawal. P.O.D. Account - Pay- on-death beneficiaries acquire the right to withdraw only if: (1) all parties creating the account die, and (2) the beneficiary is then living. It two or more beneficiaries are named and survive the death of all persons creating the account, such beneficiaries will own this account in equal shares, without right of survivorship The person(s) creating this account type reserve the right to: (1) change beneficiaries, (2) change account types, and (3) withdraw all or part of the deposit at any time. Corporate, Partnership, and other Organizational Accounts - We will usually require a separate authorization form designating the persons permitted and conditions required for withdrawal from any account in the name of a legal entity such as a partnership, corporation, or other organization. We will honor such authorization according to its terms until it is amended or terminated in writing by the governing body of such organization.

STOP-PAYMENTS - A stop-payment order must be given in the manner required by law, must be received in time to give us a reasonable opportunity to act on it, and must precisely identify the number, date and amount of the item, and the payee. A stop payment order comes too late if it is received after the earliest of the following:

  • The bank certifies the item
  • The bank pays the item in cash
  • With respect to checks, one hour after the opening of the next banking day after the banking day on which the bank received the check for settlement.
We will honor a stop-payment request by the person who signed the particular item, and, by any other person, even though such other person did not sign the item, if such other person has an equal or greater right to withdraw from this account than the person who signed the item in question. A release of the stop order may be made by any person who is authorized to draw checks against the account. For stop-payments initiated online, please refer to our Online Banking Disclosure.

ELECTRONIC OR TELEPHONE TRANSFERS - A transfer of funds from this account to another account with us, by electronic or telephone, if otherwise permitted or arranged for, may be made by the same persons and under the same conditions generally applicable to withdrawals made in writing. We restrict the number of transfers from a savings account to another account, or to third parties, to a maximum of six per month (less the number of certain "pre-authorized transfers" during the month). Other account transfer restrictions are shown elsewhere in this brochure.

AMENDMENTS AND TERMINATION - From time to time we may amend any term of this agreement upon giving you reasonable notice in writing or by any other method permitted by law, including, in appropriate circumstances, posting notice in our building. We may also close this account at any time upon reasonable notice to you and tender of the account balance personally or by mail.

STATEMENTS - You must notify us of an unauthorized signature or alteration within a reasonable time (not to exceed 14 days) after we send or make available to you your statement. If you do not notify us: (1) you cannot assert the unauthorized signature or alteration against us, and (2) you cannot assert any unauthorized signatures or alterations by the same wrongdoer on items paid by us after the reasonable time mentioned above elapses, but before we receive your notice. If you do not notify us of the problem within 30 days of when we send or make available to you the statement you lose any rights to recover from us even if we failed to exercise ordinary care in paying an item with an unauthorized signature or alteration. You must report any other problem (e.g., erroneous statement or passbook entry, missing signature, unauthorized endorsement, etc.) within this 30-day period or lose your right to assert the problem against us.

ACCOUNT TRANSFER - Acounts may not be transferred or assigned without our prior written consent. We are not required to follow any directions or notices regarding any third parties' interest (including a security interest) in your account unless we have expressly agreed otherwise.

DIRECT DEPOSITS - If, in connection with a direct deposit plan, we deposit any amount in your account which should have been returned to the Federal Government for any reason, you authorize us to deduct the amount of our liability to the Federal Government from the account or from any other account you have with us, without prior notice and at any time, except as prohibited by law. We may also use any other legal remedy to recover the amount of our liability.

SET OFF - You each agree that we may (without prior notice and when permitted by law) set off the funds in the account against any due and payable debt owed to us now or in the future, by any of you having the right of withdrawal, to the extent of such persons' or legal entity's right to withdraw. If a joint or P.O.D. account requires the signatures of all of the parties for purposes of withdrawal then the account shall be subject to set-off to the extent of the net contributions of the debtor party to the account. If the debt arises from a note, "any due and payable debt" includes the total amount of which we are entitled to demand payment under the terms of the note at the time we set off, including any balance due the date for which we properly accelerate under the note. This right of set off does not apply to the account if: (a) it is an Individual Retirement Account or other tax-deferred retirement account, or (b) the debt is created by a consumer credit transaction under a credit card plan, or (c) the debtor's right of withdrawal arises only in a representative capacity. We will not be liable for the dishonor of any check when the dishonor occurs because we set off a debt against this account. You agree to hold us harmless from any claim arising as a result of our exercise of our right of set off.

AUTHORIZED AGENT - An authorized agent is a person who by the terms of the account has a present right, subject to request, to payment from the account as agent for all of the parties to the account.

ARBITRATION - All claims or disputes between you and us shall be decided by arbitration in accordance with the Arbitration Rules of the American Arbitration Association currently in effect unless the parties mutually agree otherwise. Notice of the demand for arbitration shall be filed in writing with the other party and with the American Arbitration Association and shall be made within a reasonable time after the dispute has arisen. The award rendered by the arbitrator or arbitrators shall be final, and judgment may be entered upon it in accordance with applicable law in any court having jurisdiction thereof. This agreement to arbitrate shall be specifically enforceable under applicable law in any court having jurisdiction thereof.

INACTIVE ACCOUNTS - If no deposits or withdrawals are made or if you do not write to us indicating an interest in an account for 5 consecutive years, the account may be presumed abandoned and paid to the State as required by law.

LOST CHECKS OR ACCESS DEVICE - You agree to notify us promptly, verbally and in writing, of any suspected loss, theft, disappearance, or unauthorized use of any card, code, check, passbook, receipt or certificate permitting access to or evidencing your accounts. Until receipt of such notice, we shall not be liable for payments made except as otherwise provided by law to any person presenting any of the above described access devices, instrument or documents. We may permit withdrawals by you or issue new evidence of an account on such conditions as we may require. We may require a waiting period or proof by affidavit of the loss, theft, destruction, or unauthorized use. We may also require a bond of indemnity in any amount satisfactory to us against all claims and expenses that we may incur.

DISCLOSURE OF INFORMATION/LEGAL PROCESS - We may disclose information about your accounts or transactions on your accounts (a) to third parties where it is necessary for completing transfers or tracing transactions, or resolving errors or claims; (b) to verify or disclose the existence, amount or condition of your accounts for third parties, such as credit bureaus, merchants, or other financial institutions, (c) pursuant to court orders and other legal process; (d) to comply with subpoenas, summonses, search warrants, or requests from government agencies; (e) to other companies affiliated with us; (f) to others with your consent; and (g) wherever required by law.

As an account holder, you are deemed to be a customer of the bank and we may, from time to time, contact you by telephone to determine your level of satisfaction and/or inform you about related products and services the bank offers.

We shall not be liable to you for honoring garnishments, levies, or other legal process received by or served upon us which, in our opinion, apply or may apply to your accounts. Notice of such disclosure or process will be provided to you only when required by law.

NEGOTIABILITY - Unless we agree in writing, we will not honor any pre-printed legend that limits or conditions the negotiability of the check or draft (i.e. void after 90 days).

We maintain the option either to pay or dishonor any stale check (i.e. more than 6 months old) upon presentation to the bank. It is not recommended that you issue a post-dated check (i.e. a check bearing a date later than the actual calendar date) as a means of withdrawal. You agree that we will not be liable to you for charging your account before the indicated date on a properly payable but post-dated check unless you notify us in wirting that you have issued a post-dated check. You agree that notice concering a post-dated check will be treated as a stop payment order until the date of the check and that the corresdponding terms and fees will apply.

CHECKING ACCOUNT CUSTOMERS

For some of our Checking Accounts, we use a system that consists of two subaccounts: a checking subaccount and a savings subaccount. All of the provisions of the Deposit Account Regulations and all of the terms and conditions governing your Checking Account apply to the Account as a whole without reference to the subaccounts, except as provided in this section. If your Checking Account earns interest, the interest rate will apply to both subaccounts. If your Checking Account does not earn interest, no interest will be paid on either subaccount.

We transfer funds in the checking subaccount to the savings subaccount when such funds are not needed to pay checks, debits, or other items drawn on your Checking Account. We may establish a threshold balance in the checking subaccount and transfer any funds in excess of the threshold balance to the savings subaccount. All checks, debits and other items will be paid from balances credited to the checking subaccount. All deposits and credits will be credited to the checking subaccount. We periodically reallocate the balances between the subaccounts to make funds available in the checking subaccount to pay checks, debits and other items drawn on your Checking Account. These transfers will be the only transactions on the savings subaccount. We will not allow more than six transfers per monthly statement period from the savings subaccount and, if the sixth such transfer is made, all funds in the savings subaccount will be transferred to the checking subaccount for the remainder to the monthly statement period. Because the savings subaccount is used for internal purposes only, you cannot access this account directly. These transfers will occur solely on our books and will not appear on your Account statement and will not affect the fees of features of your Account.

In accordance with federal law, we reserve the right to require seven days' prior notice of any transfer or withdrawal from an interest-bearing account. To determine if your Account is subject to this process, please speak with your Customer Service Representative.

The Electronic Fund Transfers we are capable of handling are indicated below, some of which may not apply to your account. Please read this disclosure carefully because it tells you your rights and obligations for these transactions. You should keep this notice for future reference.

Direct Deposits - You may make arrangements for certain direct deposits to be accepted into your Checking or Savings accounts.

Pre-authorized Withdrawals - You may make arrangements to pay certain recurring bills from your Checking or Savings accounts.

The bank permits electronic debits originated by payees that convert a check into an ACH debit.

ATM Transfers - types of transfers and frequency and dollar limitations - You may access your account(s) by ATM using your ATM card and personal identification number, to:

  • Refer to the ATM/EZPay Check Card disclosure for transaction limitations
  • Make deposits to checking or savings account(s) with an ATM card
  • Transfer funds from savings to checking account(s) with an ATM card
  • Transfer funds from checking to savings account(s) with an ATM card
  • Get information about the account balance of your checking accounts
  • With an ATM card- get information about the account balance of your savings accounts
Some of these services may not be available at all terminals. Please also see the Limitations on Frequency of Transfers section regarding limitations that apply to ATM transfers.

Types of Debit Card Transactions - If you qualify for our EZPay Check Card you may access your Checking accounts to purchase goods (in person), pay for services (in person), and get cash from a merchant, if the merchant permits, or from a participating financial institution.

Debit Card Transactions - frequency and dollar limitations -

Using your debit card:

  • Refer to the ATM/EZPay Check Card disclosure for transaction limitations.
Please also see Limitations on Frequency of Transfers section regarding limitations that apply to debit card transactions.

Limitations on Frequency of Transfers - In addition to those limitations on transfers described elsewhere, the following limitations apply:

  • Transfers from a Money Market account to another account or to third parties by pre-authorized, automatic, or telephone transfer are limited to six per statement cycle with no more than three by check or similar order to third parties.
  • Transfers from a Statement Savings account to another account, or to third parties by pre-authorized, automatic, or telephone transfer are limited to six per statement cycle with no more than three by debit card or similar order to third parties.
CHARGES FOR ELECTRONIC FUND TRANSFER
We do not charge for direct deposits to any type of account.
We do not charge for pre-authorized withdrawals from any type of account.
Except as indicated elsewhere, we do not charge for electronic fund transfers.

RIGHT TO DOCUMENTATION

Terminal Transfers. You can get a receipt at the time you make any transfer to or from your account using one of our automated teller machines or point-of-sale terminals.

Direct Deposits. If you have arranged to have direct deposits made to your account at least once every 60 days from the same person or company, you can call us at (414) 874-2489 to find out whether or not the deposit has been made. If the only transfers to or from your account are direct deposits, you will get a quarterly statement from us.

Periodic Statements. You will get a monthly account statement from us for your Checking or Money Market accounts. You will get a monthly account statement from us for your Statement Savings accounts, unless, there are no transfers in a particular month. In any case, you will get a statement at least quarterly. If a passbook account receives one or more electronic transfers to or from the account, we reserve the right to change the account from a passbook account to a statement savings account without notice.

Right to Stop Payment and Procedure for Doing So. If you have told us in advance to make regular payments out of your account, you can stop any of these payments. Here is how:

Call or write us at the telephone number or address listed below in time for us to receive your request three business days or more before the payment is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within 14 days after you call.

Notice of Varying Amounts. If these regular payments may vary in amount, the person you are going to pay will tell you, 10 days before each payment, when it will be made and how much it will be. (You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment, or when the amount would fall outside certain limits that you set).

Liability for Failure to Stop Payment of Pre-authorized Transfer. If you order us to stop one of these payments three business days or more before the transfer is scheduled, and we do not do so, we will be liable for your direct losses or direct damages.

OUR LIABILITY

Liability for Failure to Make Transfers. If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your direct losses or direct damages. However, there are some exceptions, We will NOT be liable for instance: (a) If, through no fault of ours, you do not have enough money in your account to make the transfer; (b) If the transfer would go over the credit limit on your overdraft line, if you have one; (c) If the automated teller machine where you are making the transfer does not have enough cash; (d) If the terminal or system was not working properly and you knew about the breakdown when you attempted the transfer; (e) If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions we have taken; (f) If the funds in your account are subject to legal process or other encumbrance restricting the transfer; (g) if we are holding uncollected funds in your account and the transfer would require the use of those funds. There may be other exceptions in our agreement with you.

DISCLOSURE OF ACCOUNT INFORMATION TO THIRD PARTIES

We will disclose information to third parties about your account or the transfers you make:

  1. where it is necessary for completing transfers;
  2. in order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant;
  3. in order to comply with government agency or court orders; or
  4. if you give us written permission.

Tell us AT ONCE if you believe your card and/or code has been lost or stolen. Telephoning is the best way keeping your possible losses down. You can lose no more than $500 if you fail to give us notice of a lost or stolen card and/or code. If you do give us notice of a lost or stolen card and/or code, you will be liable for the lesser of:

1. $50 or 2. the amount of any money, property, or services obtained by unauthorized use of the card and/or code before you gave us notice.

Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we could have stopped someone from taking the money if you had told us in time.

If a good reason (such as long trip or hospital stay) kept you from telling us, we will extend the time period.

If you believe your card and/or code has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, call us at (414) 874-2489.

ERROR RESOLUTION

In case of errors or questions about your electronic transfers or if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt, call or write us at the telephone number or address listed in this disclosure, as soon as you can. We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error occurred.

  1. Tell us your name and account number (if any).
  2. Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
  3. Tell us the dollar amount of the suspected error.
If you notify us orally, we may require that you send us your complaint or question in writing within 10 business days.

We will tell you the results of our investigation within 10 business days (20 business days if the transfer involved a point of sale transaction or a foreign intitiated transfer) after we hear from you and we will correct any error promptly. If we need more time, however, we may take up to 45 days (90 days if the transfer involved a point-of-sale transaction or a foreign intitiated transfer) to investigate your complaint or question. If we decide to do this we will recredit your account within 10 business days (5 business days if the transfer involved a point-of-sale transaction or a foreign intitiated transfer) for the amount you think is in error, so that you will have use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or questions in writing and we do not receive it within 10 business days, we may not recredit your account.

If we decide that there was no error, we will send you a written explanation within three business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.

This Policy statement applies to all deposit accounts. For purposes of this section, deposit account does not include time deposits and savings deposits, including money market demand accounts.

Our policy is to make funds from your deposits available to you on the first business day after the day we receive your deposit. Electronic direct deposits will be available on the day we receive the deposit. Once they are available, you can withdraw the funds in cash and we will use the funds to pay checks that you have written.

Please remember that even after we have made funds available to you, and you have withdrawn the funds, you are still responsible for checks you deposit that are returned to us unpaid and for any other problems involving your deposit.

For determining the availability of your deposits, every day is a business day, except Saturdays, Sundays, and Federal holidays. If you make a deposit before closing on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit after closing or on a day we are not open, we will consider that the deposit was made on the next business day we are open.

If we cash a check for you that is drawn on another bank, we may withhold the availability of a corresponding amount of funds that are already in your account. Those funds will be available at the time funds from the check we cashed would have been available if you had deposited it.

If we accept for deposit a check that is drawn on another bank, we may make funds from the deposit available for withdrawal immediately but delay your availability to withdraw a corresponding amount of funds that you have on deposit in another account with us. The funds in the other account would then not be available for withdrawal until the time periods that are described elsewhere in this disclosure for the type of check that you deposited.

LONGER DELAYS MAY APPLY

In some cases, we will not make all of the funds that you deposit by check available to you on the first business day after the day of your deposit. Depending on the type of check that you deposit, funds may not be available until the fifth business day after the day of your deposit. However, the first $100 of your deposits will be available on the first business day after we receive your deposit.

If we are not going to make all of the funds from your deposit available on the first business day after we receive your deposit, we will notify you at the time you make your deposit. We will also tell you when the funds will be available. If your deposit is not made directly to one of our employees, or if we decide to take this action after you have left the premises, we will mail you the notice by the day after we receive your deposit.

If you will need the funds from a deposit right away, you should ask us when the funds will be available.

In addition, funds you deposit by check may be delayed for a longer period under the following circumstances:

  • We believe a check you deposit will not be paid.
  • You deposit checks totaling more than $5,000 on any one day.
  • You redeposit a check that has been returned unpaid.
  • You have overdrawn your account repeatedly in the last six months.
  • There is an emergency, such as failure of communications or computer equipment.
We will notify you if we delay your ability to withdraw funds for any of these reasons, and we will tell you when the funds will be available. They will generally be available no later than the eleventh business day after the day of your deposit.

SPECIAL RULES FOR NEW ACCOUNTS

If you are a new customer, the following special rules will apply during the first 30 days your account is open.

Funds from electronic direct deposits into your account will be available on the day we receive the deposit. Funds from deposits of cash, wire transfers, and the first $5,000 of a days total deposits of cashier's, certified, teller's, traveler's, and federal, state and local government checks will be available on the first business day after the day of your deposit if the deposit meets certain conditions. For example, the checks must be payable to you (and you may have to use a special deposit slip). The excess over $5,000 will be available on the ninth business day after the day of your deposit. If your deposit of these checks (other than a U.S. Treasury check) is not made in person to one of our employees, the first $5,000 will not be available until the second business day after the day of your deposit.

Funds from all other check deposits will be available on the eleventh business day after the day of your deposit.

We supply this statement so you can familiarize yourself with the operational and legal functions of an ATM or EZPAY check card. Please read this statement carefully as it contains important information about electronic funds transfer. Retain this along with your other account records in case you have any questions in the future.

In this statement, the words "you", "your" and "yours" mean any holder or other authorized user of your ATM (Automated Teller Machine) or EZPAY Check Card. The words "we", "our", and "us" mean Tri City National Bank. "Checking account" means your NOW account or checking account. "Savings account" means your regular statement savings account. "EFT Terminal" means an electronic funds transfer terminal; this includes automated teller machines, point-of-sale terminals, and other EFT devices. "ATM and EZPAY Check Card" means each magnetically encoded debit banking card provided to you by us. "PIN" means the personal identification number either assigned to you or selected by you for use with your ATM or EZPAY Check Card.

  1. ATM and EZPAY Check Card. Each card issued to you is our property and may be canceled or repossessed by us at any time, with or without cause. You must surrender to us on demand each ATM or EZPAY Check Card issued to you. If you permit or authorize other persons to use your Card and PIN, you will be liable on or for the resulting transactions. To guard against anyone making a transaction that you have not authorized, you should take all reasonable precautions to prevent any other person from learning you PIN.
  2. Business Days. For purposes of these disclosures, our normal business days are Monday through Friday (Excluding Holidays).
  3. Account Access. You may use your ATM or EZPAY Check Card to:

    Withdraw cash from the deposit account(s) designated or your overdraft credit lines (if applicable).

    • Inquire as to the available balance of your designated account(s).
    • Make deposits to your designated account(s)
    • Transfer funds between designated accounts.
    • Pay for purchases from your account at places that have agreed to accept Visa or ATM cards.
    • Make loan payments to us.
    • Some of these services may not be available at all terminals. The ATM and EZPAY Check Cards are for personal or household use only.
  4. Deposits. Funds from any deposits (cash or checks) made at a Tri City National Bank Automated Teller Machine (ATM) before 6:00 p.m., will be made available on the second business day after the day of deposit. Funds from any deposits made at a non-Tri City National Bank ATM before 6:00 p.m., will be made available the third business day after the day of deposit.
  5. Time of Determining Sufficiency of Account Balance. Each time you use your ATM or EZPAY Check Card, the amount of your transaction may immediately be debited from your account balance and may not be available to pay any checks or other items which are later processed to your account. This will be the case even if the merchant does not immediately seek settlement of your transaction.
  6. Transaction Receipts. You will get a receipt at the time you make any transfer to or from your account using an EFT terminal.

    A fee may also be imposed by a terminal/network operator if you initiate a transfer from a terminal that is not operated by us.
  11. Periodic Statements. You will get a monthly account statement for your checking account. You may get a monthly account statement for your savings account combined with your checking account statement. If you receive a separate savings account statement, you will get a monthly statement unless there are no transfers initiated in the United States in a particular month. In any case you will get the savings account statement at least quarterly.

    Contact us promptly if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. YOU MUST CONTACT US ONLY AT THIS TELEPHONE NUMBER OR ADDRESS ABOUT YOUR ERRORS OR QUESTIONS. We must hear from you no later than 60 days after we sent you the FIRST statement on which the problem or error appeared.

    1. Tell us your name and account number (if any)
    2. Describe the error or the transfer you think is incorrect, and clearly explain why you believe it is an error or why you need more information.
    3. Tell us the dollar amount of the suspected error and, if possible, the date it appeared on your statement.
    4. It will be helpful to us if you also give us a telephone number at which you can be reached during business hours in case we need any further information.
    If you notify us orally, we require you to send us your dispute or questions in writing, within 10 business days following the date you notified us.

    We will report to you the results of our investigation within 10 business days following the date you notified us and if we made an error, we will correct the error promptly. If we need more time, however, we may take up to 45 calendar days to investigate your dispute or questions following the date you notified us. If we decide to use more time to investigate, we will credit your account within 10 business days from the date you notified us of the error, so that you will have use of the money during the time it takes us to complete our investigation. If we ask you to put your dispute or question in writing and we do not receive it within 10 business days following your oral notification, we may elect not to credit your account.

    In the case of a transfer resulting from a point-of-sale transaction (signature based) or a transfer initiated outside the United States we may take up to twenty (20) business days to tell you the results of an investigation, or alternatively re-credit your account and resolve the error within ninety (90) days.

    If we decide that there was no error, we will send you a written explanation within 3 business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.

  13. Consumer Liability Disclosure. Tell us AT ONCE if you believe your ATM or EZPAY Check Card or PIN number has been lost or stolen. Telephoning is the best way of minimizing any possible liability or loss. You could lose all the money in your account (plus your maximum overdraft line of credit, if applicable). If you tell us within two (2) business days after you learn of the loss or theft, you can lose no more than $50.00 if someone used your card or PIN without your authorization and you used reasonable precautions in protecting the security of your card and PIN. If you do NOT tell us within two (2) business days after you learn of the loss or theft or your card or PIN, and we could have stopped someone from using your card or PIN without your permission if you had told us, you could lose as much as $500.00.

    Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we could have stopped someone from taking the money if you had told us in time.

  15. Our Liability for Failure to a Make Transfer. If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your direct losses or damages. However, there are some exceptions. We will NOT be liable, for instance: (a) If through no fault of ours, you do not have enough money in your account to make the transfer; (b) If the transfer would go over the credit limit on your overdraft line, if you have one; (c) If the automated teller machine where you are making the transfer does not have enough cash; (d) If the EFT Terminal or processing system was not working properly and you knew about the breakdown when you attempted the transfer; (e) If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions we have taken; (f) If the funds in your account are subject to legal process or other encumbrance restricting the transfer; (g) If your PIN, ATM or EZPAY Check Card is reported lost or stolen; or (h) If we are holding uncollected funds in your account and the transfer would require the use of those funds. There may be other exceptions stated in our account agreement with you. We will not be liable for any indirect, incidental or consequential damages.
  16. Disclosure of Account Information. We will not disclose information to third parties about your account or the transfers you make except:
    • If it is necessary for completing or tracing transactions or resolving errors or claims, or
    • In order to verify the existence and conditions of your account for third parties, such as a credit bureau or merchant, or
    • In order to comply with government agency or court orders, or
    • If you give us written permission.
  17. Modifications of this Statement; Termination. The terms of this Statement may be changed by us from time to time by notice from us to you. We may also revoke your right to use your ATM or EZPAY Check Card at any time. You agree to pay us for any cash withdrawals, service charges, or other items that remain unpaid at the time this agreement is for any reason terminated.
  18. Applicable Law. These terms and conditions are subject to the laws and regulations of the State of Wisconsin and any applicable federal laws, especially the law regarding electronic funds transfer. This body of law is too large and complex to be reproduced here. We may permit some variation from this standard agreement, but any such variations must be agreed to in writing either on our signature card for the account or in some other written form.

Important Information Regarding Your Tri City National Bank 24 Hour ATM or EZPAY Check Card

Keep your PIN confidential.

  • Never write your PIN on your ATM or EZPAY Check Card or repeat it to others.
  • Never carry your PIN in written form, in your purse or wallet, with your ATM or EZPAY Check Card.
  • Never give your PIN to anyone over the telephone. Your PIN is only required for in-person ATM transactions. Tri City National Bank will not ask you to disclose your PIN over the telephone.
If your ATM or EZPAY Check Card is not used within a six-month period of time, the card will automatically be closed.
